The LIGHT Photobooth/360 Booth TERMS & CONDITIONS

The Following Terms and Conditions set forth the full, written intention of both parties and supersedes all other written and/or oral agreements between the parties.

This website is operated by THE LIGHT Photobooth Throughout the site, the terms “we”, “us” and “our” refer to The LIGHT Photobooth offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Our store is hosted on Squarespace. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

1 SERVICE PERIOD

1.1 Vendor agrees to have The Light Photobooth operational for a minimum of 95% of the clients service period. Occasionally operations may need to be interrupted for normal maintenance of the photo booth i.e., changing of ink cartridges, media paper etc. If in the event the normal maintenance time exceeds 5% of the clients service period the client will be reimbursed the amount of time the photo booth is inoperable, that amount to be pro-rated.

1.2 When service is more than 3 hrs attendant may go for a 10 min bathroom break, then the service will be closed during those 10 minutes.

2 DEPOSIT PAYMENT and FINAL PAYMENT

2.1 Deposit of $185.00 per service to be made in full at time of purchase. If final payment is not made in full at time of purchase then the remaining amount due is to be paid in full one day before the client’s event, unless otherwise stated. If client fails to make the remaining payment at clients event date, the event will be cancelled and the client will forfeit whatever monies were paid up to that point.

2.2 If the client uses the equipment for a period of time in excess of the service period agreed to the overage in rental time will be billed to the client at the following rate: $100.00 per hour. $65.00 per half an hour.

2.3 If you paid a deposit payment but you are still not sure about the date of your event, deposit payment can be held only for 90 days . The Light Photobooth will do a follow up (two times) to the client to make sure they have a date for the event (during the 90 days period). If the 90 days passes and there is no date or contact with the client the paid deposit will NOT be refundable.

2.4 Paid Deposit for Audio Guestbook will be refunded at the end of the night when equipment gets picked up and checked it has not been damaged.

We accept Cash, Zelle, PayPal or SquareUp payments.

3 PACKAGE PRICES

3.1 Are subject to change due to material shortages or cost (paper, ink for pictures, memberships, liability insurance, wages and or gas). The client will be notified by email that the client booking agreement has a price change. / Prices were modified on September 2022.

4 DATE CHANGES , CANCELLATIONS OR CHANGE OF SERVICE

4.1  CHANGE of booth service has a charge of $35.00

4.2 Event cancellations have an $85.00 cancellation fee per service.

4.3 Any request for a date change must be made in writing at least 30 days in advance of the original event date. Change is subject to photo booth availability and receipt of a new service contract at a $35.00 fee. If there is no availability for the alternative date, the event can be cancelled and a $85.00 cancellation fee.

4.5 If the client requests cancellation within 24-72 hours before the event any monies received up to that point will NOT be refunded.

4.6 And or The Light Photobooth/360booth/Socialbooth has to cancel the services for any reason or any time a complete refund will be made to the person who signed the booking form.

4.7 Refund will be sent thru the same way payment or deposit was made, (Paypal or Zelle) The Light Photobooth is not responsible for any other fees from those digital app.

 5. ACCESS, SPACE & POWER FOR PHOTOBOOTH/360 Booth

5.1 Client will arrange for an appropriate space for the photo booth/360 Booth at the designated venue (10’ deep x 10’ wide x 10’ high).

5.2 Client is responsible for providing a power source for the photo booth (110V, 10 amps, 3 prong outlet). Flat, clean and dry surface,

5.3 Backdrop needs to be towards a wall with no windows, doors, stairs, or emergency exits.

5.4 Photo booth’s ARE NOT mobile. Please plan accordingly

5.5 Areas that Photobooths CAN NOT be close to set up: Bathroom, Bar Area, Children’s play area, Pools, Emergency Exits.

6. 360 BOOTH OPERATIONS:

To use the 360 Booth, guests are required to stand on a circular platform while a camera arm spins around them 3 or 4 times in a full 360 motion. Depending on the photo booth model used at the client’s event, the camera may remain static while the camera arm rotates in a full 360 motion. Guests are required to stand firmly in the middle of the platform without extending their feet over the edge. 3 people maximum can safely use the platform at the same time. Our attendant will be on hand to assist guests when needed and safety restrictions may be enforced in and around the 360booth during operations. Children under 11 years old need to be accompanied and supervised by an adult. The LIGHT Photobooth is not liable for any injuries or damages arising from improper use of the 360booth and/or other associated equipment.

7. MEDIA DELIVERY:

7.1 Guests can instantly access their 360 videos, GIF’s, Digital photos via SMS, Airdrop, or Email is available as part of this service. The LIGHT Photobooth is not responsible for what guests do with the videos when they access, share or store them. An online gallery of all media created by our Print Photobooth, Social Booth, 360 booth and Audio voice messages at the event will be made available to the client within 3-5 business days after the event.

7.2 The Gallery for photos, GIFs, Videos and Audios will only be available for 90 days in the cloud, after 90 days the file will be deleted. The client is responsible for archiving and protecting the media content. The LIGHT Photobooth is not responsible for the lifespan of any digital media provided or any future changes in digital technology that may result in an inability to access or use the files.

7.3 The LIGHT Photobooth uses 3rd party services to process, store, share and manage videos and or photos. The LIGHT Photobooth is not responsible and cannot be held liable for any 3rd party claims relating to our services. The LIGHT Photobooth cannot take full responsibility when the 3rd party service is experiencing server issues, (uploading, downloading, saving, sharing, link error, internet, WiFi, etc.) The Light Photobooth will do everything on their end to keep a copy of the videos or photos by having a backup to keep your memories safe. If your videos or photos are lost for any reason mentioned above a refund will be issued to you and we only be charging a travel fee of $85.00

8. OUTDOOR EVENTS

8.1 If the event is to be held outdoors, the client understands the photobooth can be shut down during the event due to inclement weather (heat, wind, rain, snow, hail or sleet). If there is inclement weather and the photo booth/360 has to be shut down, the event will be cancelled and any monies given is non-refundable. The LIGHT Photobooth suggests that clients have a contingency plan in place for outdoor events to prevent a possible shut down due to inclement weather. A contingency plan can be to have indoor space available at time of the event so the event can be moved indoors prior to setting up. The Light Photobooth will only set up and break down equipment one time so please plan accordingly.

9 DAMAGE TO VENDOR’S EQUIPMENT

Client acknowledges that client shall be responsible for any damage or loss to the vendor’s equipment caused by:

9.1 Any misuse of the vendor’s equipment by client or its guests, or

9.2 Any theft or disaster (including but not limited to fire, flood or earthquake). Vendors at his/her sole discretion can cancel the event due to clients and/or guests misuse and damage to vendors equipment.

9.3 If the event is cancelled for these reasons, any monies paid for the event is non-refundable.

10 INDEMNIFICATION

Client agrees to, and understands the following:

10.1 Client will indemnify the vendor against any and all liability related to the client’s event.
10.2 Client will indemnify vendor from the time of service and on into the future, against any liability associated with the client.
10.3 Client will indemnify the vendor against any and all liability associated with the use of pictures taken by The Light Photobooth, its representatives, employees or affiliates at client’s event.

11. INSURANCE

11.1 Vendor will have their own general liability insurance policy in place at the event unless the venue has insurance whereby the venue’s general liability insurance policy will govern.

12. MISCELLANEOUS TERMS/ Privacy Policy

If any provision of these terms shall be unlawful, void, or for any reason unenforceable under contract law, then that provision, or portion thereof, shall be deemed separate from the rest of this contract and shall not affect the validity and enforceability of any remaining provisions, or portions thereof. This is the entire agreement between vendor and client relating to the subject matter herein and shall not be modified except in writing, signed by both parties. In the event of a conflict between parties, the client agrees to solve any arguments via arbitration. If the printer fails to print out photos on site the vendor will be allowed to give a web site to the client where their guests can log onto and print pictures free of charge with the ability to download the digital files for their own use. Vendor is not responsible for any consequential damages or lost opportunities upon breach of this agreement.

The LIGHT Photobooth reserves the right to use all media produced by The Light Photobooth Prnt/360Booth/Social Booth and or Audio Guest messages for advertising and promotional purposes on our website, social media, or 3rd party platforms. The LIGHT Photobooth has the right to overlay photo templates and 360 Glam videos with, The LIGHT Photobooth marketing assets to further more promote The LIGHT Photobooth business.

By signing this agreement, you, the client, warrant that you, the client, have the authority to agree to the use of the likeness of all persons included in the images from your event. You, the client, agree with us, The LIGHT Photobooth taking and using such images as described and releasing The Light Photobooth of any, and all claims regarding use.

13. COVID-19 Terms

The LIGHT Photobooth is keeping you, the client, safe and protected by following the CDC recommended guidelines for business. www.cdc.gov/coronavirus/2021-ncov/community/reopen-guide.html

All our The LIGHT Photobooth, staff are required to wear masks all the time. Also our props are easy to clean and sanitized. A gel sanitizer will be provided for guests to use before grabbing any of the props.

14. MONKEYPOX

The LIGHT Photobooth is keeping you, the client, safe and protected by following the CDC recommended guidelines for business.https://www.cdc.gov/poxvirus/monkeypox/transmission.html

Monkeypox can spread to anyone skin to skin contact, including: Touching objects, fabrics (clothing, bedding, towels), and surfaces that have been used by someone with monkeypox. For these reasons it is our responsibility to let you know that props (hats, glasses, wood props, flowers, etc..) are objects that people will touch and use during photo sessions. Also, our props are easy to clean and sanitized. A gel sanitizer will be provided for guests to use before and/or after grabbing any of the props. Please let us know if you still want to get props in your package. The package fee without a props package will vary.

15. TRAVEL RANGE

15.1 The LIGHT Photobooth serves all Orange County and Surrounding Areas! Staring 09/15/23 FREE Travel fee is not longer available due to the High Cost of Gas.)

15.2 . Travel Fee a $0.67 cents per mile from Zip code 92707.

15.3 If the client’s location for the client’s event is more than 45 miles, The LIGHT Photobooth only can book for 3 hrs or more . If the client’s location for the client’s event is more than 55 miles The LIGHT Photobooth can only book 4 hrs or more.

15.4 The 2023 standard mileage rate for business travel will be 62.5 cents per mile.

16. CLIENT RESPONSIBILITY:

16.1 It is the Client's responsibility to provide The Light Photobooth/360 Booth and our attendants a safe working environment free from hazards, attacks, threats of violence, or harassment of any kind. The attendant reserves the right to cease operations immediately and take possession of all equipment if they become unsafe. No refunds will be made under such circumstances .

17. CHILDRENS:

17.1 Children under 11 years old MUST be accompanied all the time by an adult when using Print Photobooth, Socialbooth, 360 Booth or Audio Guestbook..

18. COMPLIMENTARY SERVICE:

18.1 You should also ask the venue/caterer for an estimate that includes your vendor meals so that you can plan accordingly. If your event is more than 3 hours of service, it is standard practice to feed your vendor (Attendant for the booth) We really appreciate your consideration and kindness. Thank YOU!

19. FINAL WORK :

If the final work or performance is not 100% satisfactory to you send us an email to photoboothlight@gmail.com explaining why our work was not 100% satisfactory, We will take into consideration your thoughts and concerns. We will respond to your email with our final thoughts. It is in our best interest to give you the best memories for your event. We want to give you 100% final work.

20. The Light Photobooth Packages Fees are based on all these charges. Not Just on take the photos and videos.

Insurance, Payroll, Business License, Travel Fees, Paper and Ink for photos, Video Apps Subscriptions, Software License, Webpage, Payment Apps Fees, Booking forms Subscriptions, Advertising, Overlays and Templates Design Subscriptions, Designer Person, Set Up/Teardown, Equipment Maintenance, Cleaning Supplies.

We are a professional and honest company that wants to give you the best for your event.
